Galaxy – Game Rules
|The following general rules (the “Rules”) apply to all gaming contracts entered into between the Company and a Player from the date of their approval from the Gambling Monitoring Unit.
These Rules apply for participation via authorized Retail Outlets with online equipment, as well as for participation via new media (Internet).
Unless the context clearly indicates otherwise, the following words shall have the following meaning when used in these Rules:”Company” – the licensed operator of the National Lottery, Lotaria Kombëtare sh.p.k. with its legal seat in Tirana, Albania, and its business address at Str. “Dritan Hoxha”, Nr. 39-1, registered with the National Registration Centre under NUIS L22119005R;”Computer System” – Technical equipment specified by the Company for the purpose of participating in Galaxy;“Draw” – The process which culminates in the selection of a winning number or symbol for Galaxy on a random basis.“Albanian Law on Games of Chance” – Law Nr. 10033, dated December 11th, 2008, as amended from time to time or any other Game of Chance Law that abrogates the existing one;“Game Closing Time” – means with respect to a Draw the time which has been determined and published by the Company as the time after which no participation is allowed to be placed in respect of that Draw.“Holder” – is a person that has acquired physical possession of a Ticket.“Galaxy” – is a game operated by the Company the results of which are determined by a Draw.“Person” – is an individual over the age defined by the Gambling Act who may be interested in the participation in Galaxy“Player” – is a Person who purchases or otherwise acquires a Ticket the data on which have been confirmed by the Company through the Computer System through the printing of such Ticket.
“Retail Outlet” or “Authorised Agent” – shall mean a retail outlet which appears as such in the list of Retail Outlets published by the Company at http://www.lotaria.al and which is equipped with technical appliances that form part of the Computer System and having capacity for immediate data transmission according to the specifications of the Company.
“Ticket” – is a ticket which has been printed out by the Computer System, the data on which have been confirmed by the Computer System and which contains, amongst others, the following constitutive elements in clearly legible form: (i) the Galaxy game type and the number/the combination of numbers and symbol/s chosen; (ii) the date, time, number of Draw that it is issued for; (iii) the barcode; (iv) the Ticket number (v) the value.
“Media” – means tools used to store and deliver information or data.
“Participation” and other words deriving thereof with reference to Galaxy refer to the acquisition of a Ticket.
“Terminal” – part of the Computer System; technical device in a Retail Outlet for enabling Persons to participate in Galaxy and the printing out of Tickets for Players;
“Force Majeure” – means any event or effect that cannot be reasonably anticipated or controlled and without the fault or negligence of the non-performing party. As herein used, Force Majeure means acts of war, terrorism, action of the elements (e.g. fire, flood, storm, etc.), electrical power outage, rationing, material damage, civil disturbance, or any other cause which is beyond the control of a party affected and which, by the exercise of reasonable diligence, said Party is unable to prevent or to predict and through advance planning avoid.
a. Legal basis
a.1 By participating in Galaxy, the Players accept the following Rules and undertake to observe them. These Rules, and the data, conditions and explanations appearing on Tickets constitute the entire agreement and contractual rights and obligations of the Company to Players with respect to the game “Galaxy”.
a.2 The operation of Galaxy is based on the Albanian Law on Games of Chance and the License Agreement granted to it by the Republic of Albania acting through the Ministry of Finance, for the period of such license with the law no. 95/2013, dated 04.03.2013.
b. Description and duration of Game
b.1 In game “GALAXY” there is a total of eighteen (18) fields with twelve (12) fields each marked with numbers from one (1) to twelve (12), a field with a “star” symbol, a field with a “sun” symbol, a field with a “moon” symbol, a field with a “clover” symbol, a field with a “horseshoe” symbol and a field with a “bell” symbol.
b.2 Numbers from 1 to 12 and all symbols belong to nine (9) different sectors. In Sectors I, II and III are six (6) fields in each sector. Numbers 1, 11, 8, 7 and symbols “sun” and “clover” belong to Sector I, numbers 4, 2, 9, 6 and symbols “moon” and “horseshoe” belong to Sector II and the numbers 12, 10, 3, 5 and symbols “star” and “bell” belong to Sector III. In sectors A, B, C, D, E and F are three (3) fields in each sector. Symbol sun and the numbers 1 and 11 belong to Sector A, symbol clover and the numbers 8 and 7 belong to Sector B, symbol moon and the numbers 4 and 2 belong to Sector C, symbol horseshoe and the numbers 9 and 6 belong to Sector D, symbol star and the numbers 12 and 10 belong to Sector E and symbol bell and the numbers 3 and 5 belong to Sector F, Fields with numbers from 1 to 6 belong to the small numbers grouping and the fields numbered from 7 to 12 belong to the big numbers grouping.
b.3 Fields with numbers and symbols are colored red, black, gold and green. Six fields with the numbers 2, 5, 6, 7, 10 and 11 are red, fields numbered with 1, 3, 4, 8, 9 and 12 are black, three fields containing the star, sun and the moon symbols are gold and three fields containing the clover, the horseshoe and the bell symbols are green.
b.4 In this game, prize is won when the played field or symbol on the printed game ticket matches the field with the number or symbol drawn. Drawing is made by electronic generator of randomness with an animated shuffled ball that stops on one of the fields with number or symbol. A number or a symbol is considered to be drawn when the ball has finally stopped.
b.5 The game “Galaxy” is conducted in series. Each series consists of multiple Draws. Ticket purchases are accepted in precisely defined time periods (intervals) between each Draw.
b.6 The Company shall determine the number of the Draws within one series, the time interval between the Draws and the opening and close-off times for ticket purchases.
b.7 At any time and in its sole discretion the Company may temporarily suspend and/or stop conducting Galaxy for the herewith mentioned reasons but not limited to: system incidents/technical issues, product revenues that is connected to: dependents on seasonality /pick of picks, networking (if the planed network is not as per the plan and the company revenues are impacted), fiscal obligation increases, retailer issues, or other regulations not allowing product selling to the target group, thus reflecting in revenues, operational costs or other company product focus; force majeure, national holidays, unforeseen situations. In doing so, the Company shall determine the time of the last Draw, the duration of the break, if any, and the time of commencement of the next series, of which the Company shall inform the Persons in a timely manner.
b.8 The Company reserves the right to change the times (schedule) of the Draws and the time interval between the Draws, and shall inform the Persons in a timely manner.
c. Conditions for participation in Galaxy
c.2 The Company may terminate the use of existing Media for gaming Participation or introduce new ones and make use of new technical Media of different types to arrange gaming participation.
c.3 Participation in Galaxy
c.3.1 Entering game of Galaxy is made by offering to purchase a ticket through an online system at a Retail Outlet of the Company requesting the predicted number(s) and/or simbol/s into a Terminal. In one ticket can be played up to three Galaxy games.
c.4 Participating in one or several future Draws
c.4.1 Persons may participate in one or more Draws. The Person can offer to purchase a ticket and enter a Galaxy Draw which is scheduled at an exact future time – («DRAW (DAY)», «DRAW (HOURS)» and «DRAW (MINUTES)»). If a Person does not indicate a (predefined) Draw date and a Draw time he/she wishes to participate in, this will be deemed as an offer to conclude a contract for playing only in one Draw and the gaming contract will be concluded only for the one Draw directly following the submission of the number combination.
c.4.2 Persons may also offer to participate in several future Draws («SUBSCRIPTION»). When a Person wishes to participate in a particular Draw which is scheduled at a specified time and at the same time wishes to subscribe to several future Draws, by selecting «SUBSCRIPTION», the Person specifies the number and the time gap between the following Draw(s). The Person can specify the time for the first Draw in subscription up to 7 days in the future and for the other Draws in subscription by selecting a time gap of 5 minutes, 10 minutes, 15 minutes, 20 minutes, 30 minutes, 1 hour or 1 day between the selected Draws. The subscription option allows for playing in 2, 3, 4, 5, 6, 7, 8, 9 or 10 draws. The Computer System will print respective Tickets corresponding to the payments performed.
c.4.3 Moreover, a «MULTIPLIER» option allows a Person to multiply his/her stake by 2, 3, 4, 5, 6, 7, 8, 9, 10, 20, 25, 30, 50 and / or 100. The Person can increase value played through multiplication, provided that the value does not exceed the maximum allowed ticket value for a game of Galaxy.
c.5 Entry to the Game is conducted on anonymous basis.
c.6 The minimum age for Participation is according to the provisions of the Gambling Act.
c.7 Retail Outlets
c.8 The transmission of Galaxy Game data and the forwarding of the stakes paid by the Player to the Company are exclusively carried out via Retail Outlets.
c.9 Participation in the respective Draw(s) is arranged by the Retail Outlets. Neither the Retail Outlet nor the Company shall be deemed to have taken any obligations be it under contract or tort, towards a Player with regard to the prediction of the number(s) and symbol(s) as winning or potentially winning number(s) and symbol(s).
c.10 Participation Data
c.10.1 The data shall be transmitted from the Retail Outlets to the Company using the Computer System.
c.10.2 The data must be transmitted to the Company prior to the Game Closing Time for that Draw. Data received by the Company after the respective Game Closing Time shall be deemed to take part in the subsequent Draw.
c.10.3 Data not received electronically by the Company (thus being data in respect of which no gaming contract has been concluded due to non-receipt by the Company) will not participate in the game.
c.10.4 The Retail Outlet as well as the Company may refuse the acceptance of data for material reasons (i.e. including but not limited to obvious influence of alcohol or illegal substances, or substances that may influence the decision-making) at any time.
c.11 Stakes and Registration
c.11.1 The payment of the stake shall be confirmed to the Player by the Retail Outlet through the issuance of a Ticket featuring the barcode.
c.11.2 The proper issuance and handing over of one or several Ticket(s) featuring the barcode is a prerequisite for the Participation and further processing of the data.
c.11.3 The Ticket itself is equipped with a code which constitutes an essential component of the Ticket and ensures the correct technical allocation of the Ticket to the data played.
c.11.4 The Ticket issued to the Player serves as the sole proof of Participation in the game and is a prerequisite for any potential prize entitlement.
c.12 Participation Qualification and Gaming Contract
c.12.3 The gaming contract between the Player and the Company is valid as being concluded, if the data of the Galaxy game, transferred via the Computer System, are received by the Company, are stored accordingly and analysable, and are confirmed by printing out the Ticket(s) and handing it (them) over to the Player. In any case, the prescribed value must be paid in respect of Galaxy game. If any of these requirements are not met, the gaming contract will not be concluded.
c.13.1 The Company will be liable for any damage to the Player caused culpably by the Company after the gaming contract has been concluded.
c.13.2 The Company assumes no obligation (hence cannot be held liable) in respect of damages caused by criminal actions of third parties or in case of a Force Majeure event, or resulting from other circumstances for which the Company is not responsible.
c.13.3 The Retail Outlets will only be liable for intent and gross negligence.
c.13.4 The selection of the modalities of Participation in the respective events rests with the Player. The Retail Outlet cannot be held liable for a Player’s unintentional Participation in a game.
c.13.5 The Player bears all losses in relation to the correctness of the Ticket in terms of content, and the printing of the code. The Player is under an obligation to not accept a Ticket if it lacks its code or any other constitutive elements mentioned herein.
|c.14 Complaints lodged after the close-off time for ticket purchases will not be taken into consideration.c.15 The Ticket is the only proof of entering the game Galaxy. The Ticket is entered in the game for such series and Draw(s) as recorded in the corresponding computer record stored electronically in the central system.
c.16 A Player in Galaxy has a duty to check the Ticket immediately upon purchase. Subsequent complaints will not be taken into consideration. The Company shall not be liable for any damages incurred due to theft or other force majeure resulting in a loss or destruction of the Ticket. The winning prizes are paid out only to the Holder of the original Ticket.
ç. Place of Game implementation and territory of Ticket sale
ç.1 The Company sells Tickets and hence enables the Participation in the games via a network of authorized Retail Outlets within the territory of the Republic of Albania. Every Participation in Galaxy will be implemented via the Computer System.
d. Individual price of a Game
The minimum payment on a single Ticket for each of the games in the game “GALAXY” is 50 (fifty) ALL and the maximum payment on a single Ticket for each of the games in the game “GALAXY” is as follows:
– For one field (number/symbol) played: 2,500 ALL
d.2 The minimum and maximum value for a Ticket for any Galaxy game as specified in d.1 are subject to change by the Company, which shall inform the players in a timely manner, before such change comes into force.
e. Prize tiers
e.1 There are the following types of prizes in the game “GALAXY”:
e.3 In this game players predict possible winnings in advance, by multiplying the paid amount with the odds determined for any possible winning. By dividing number 12 with the number of fields played, the odds are determined for the below prizes:
– One field (number/symbol) odds = 12
e.4 All winning amounts are gross amounts.
e.5 The prize pyramid for Galaxy results in a calculated more than 50% of the turnover resulted from the selling of the tickets.
e.7 The Company may change prize tiers for all or part of the Galaxy game types. However, the Company is obliged to inform the Players in a timely manner before the changes come into force.
f.1 The Ticket for the Galaxy game is printed on a thermal paper and it contains:
f.2 The Ticket may also contain other information.
f.3 The Ticket which does not contain the essential elements set forth in the article f.1 of these Rules shall be deemed invalid
g. Announcement of the prizes and the results of the game
g.1 The Draw results and respective prizes are published on the website of the Company and/or the Retail Shop no later than one working day after the completion of the Draw.
gj. Manner and term of payment of prizes
gj.1 Pursuant to these Rules, only the data which have been received by the Company for a specific Draw before Game Closing Time and confirmed to the Players via Tickets will participate in the determination of the stake, the determination of the number of winners within each prize tier and the respective winnings of such Draw.
gj.2 A prize entitlement can only be derived from the Ticket. The data on the Ticket must correspond to the data received by the Company, and the code on the Ticket must be clearly legible.
gj.3 Prizes will be paid out after the determination of winnings has been completed and the verification of prize payouts has been issued by the Company in accordance with these Rules.
gj.4 Any claiming of prizes shall be exclusively subject to the presentation and handing over of the original Ticket. The payment of each prize will be noted in the Computer System.
gj.5 All winning prizes represent gross amounts for tax purposes. Payment of prizes shall be subject to withholding tax. Hence, any withholding to be made on account of any applicable taxes at source shall be withheld from the winning amounts in order to be remitted to the tax authorities in compliance with all applicable laws.
gj.6 The Company in accordance with the Law no. 9917, dated 19.5.2008 “On prevention of the money laundry and financing of the terrorisms” and all the sub laws based on this law, shall take all the necessary preventive measures.
gj.7 Winnings up to gross ALL 100,000 (one hundred thousand) per properly qualified winning Ticket will be paid out to the Holder of the Ticket in cash at any Galaxy game related Retail Outlet.
gj.8 Notwithstanding the above item gj.7, Holders of any properly qualifying winning Tickets may choose to claim their prizes regardless of the winning amounts at the headquarters of the Company. The prizes exceeding the amount of gross ALL 100,000 (one hundred thousand) per properly qualified winning Ticket will exclusively be handled by Company’s headquarters and paid out to the Holder of the Ticket no earlier than one week after the Company has received the prize claim form. Such high-tier prizes will exclusively be transferred to a bank account specified on the prize claim form (or any other method of payment mutually agreed between the Company and the winner of the high-tier prize), which has to be fully completed and submitted by the Holder of the Ticket.
gj.9 In case the prize is claimed at the Company’s headquarters, the prize claim form including the enclosed original Ticket will remain with the Company. Any bank transfer or postal charges as well as all other legally prescribed fees or costs incurred in this context, if any, must be paid by the remittee.
gj.10 If a winning Ticket which is submitted to the Company together with a prize claim form in respect of Draws that will take place in the future, the Ticket will be kept on file at the Company until all Draws for which that Ticket was issued have taken place. If that Ticket is a winning Ticket on account of any other Draw (that postdate the submission of that Ticket to the Company) the corresponding winning amount(s) of such other Draw(s) will be paid out to the bank account stated on the prize claim form originally submitted to the Company. Any bank transfer or postal charges as well as all other legally prescribed fees or costs incurred in this context, if any, must be paid by the remittee.
gj.11 All payouts to winners shall have debt-discharging effect for the Company.
gj.12 Ticket Holders may claim their prize(s) for up to 90 consecutive days from the day after the respective Draw date. After this time has expired, any possible prize entitlement will have ceased.
gj.13 If several prizes are won per gaming contract, the amount of the accumulated winnings will be taken as basis for the method of payout.
gj.14 The Holder of a Ticket will not be entitled to the prize(s) if (a) the Holder has not yet turned 18 years old or cannot prove that he has turned 18 year old, (b) the Ticket has been tampered with in any way or is corrupted, or (c) the code on the Ticket is unreadable. If a Holder of a Ticket believes that the Retail Outlet has refused to pay out the prize to him/her in breach of these Rules the Holder of a Ticket must claim the prize at the Company by completing the relevant prize claim form and submitting it to the Company together with the Ticket.
gj.15 There is no obligation for the Retail Outlets or for the Company to check the entitlement of the Ticket Holder.
h. Method, procedure and control of the electronic draw and calculation of prizes
h.1 The drawing of the winning numbers and symbols in Galaxy is performed by means of an electronic or a mechanical generator of random numbers where the results of the Draws are transferred electronically.
h.2 The electronic generator is a certified random number generator which is used to draw numbers and symbols in predefined time intervals.
h.3 Prizes shall be determined i.e. calculated by the central on-line Computer System via a computer program.
i.1 These Rules may be consulted at any Retail Outlet on demand and are further published on the Company’s website.
j.1 Withdrawal from the gaming contract shall be excluded.
k. Force majeure and unexpected situations
k.1 If a Draw that has commenced cannot continue for technical reasons (power failure, interruption of broadcasting of the draw for technical reasons or force majeure, etc.), the same Draw will continue when the conditions allow the Draw to take place. The Company shall inform the Players on their website (www.lotaria.al) in a timely manner regarding the time and the manner of the Draw.
k.2 In cases when there are justified reasons, force majeure or technical malfunction, or any other reason occurred beyond the will of the Company, the latter reserves the right to cancel a scheduled Draw, to cancel the tickets purchased and refund the players in the Galaxy.
l. Final and closing provisions
l.1 The Company has an obligation to retain and not erase the electronic media for a period of at least seven years from the date of the draw and series.
